OVERVIEW

Welcome to BAREKEY. The terms “we”, “us” and “our” refer to BAREKEY LTD, trading as BAREKEY. BAREKEY operates this store and website, including all related information, content, features, tools, products and services in order to provide you with our online shopping service (the “Services”). BAREKEY is powered by Shopify, which enables us to provide the Services.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you use the Services. Please read them carefully. By visiting, interacting with or using the Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, please do not use the Services.

SECTION 1 - ACCESS AND ACCOUNT

By using the Services, you confirm that you are at least the age of majority in your country or region of residence, or that you have permission from a parent or legal guardian where required by law.

You may be asked to provide information such as your email address, billing information and shipping information. You agree that the information you provide is accurate, current and complete and that you have the right to provide it.

You are responsible for maintaining the security of your account credentials and for activity under your account. You may not transfer, sell, assign or license your account without our written permission.

SECTION 2 - OUR PRODUCTS

We make reasonable efforts to describe and display our products accurately, including their materials, appearance, specifications and compatibility information. Screen settings may affect how colors and product appearance are displayed.

Some products are custom-cut according to the device model, keyboard model, layout and options selected at checkout. Customers are responsible for reviewing their selections carefully before placing an order and should contact us before ordering if they are unsure which option to choose.

Products must be installed and used in accordance with the available installation instructions. Nothing in these Terms excludes or limits any product quality, safety or other consumer rights that cannot legally be excluded or limited.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase the products in your order. Your order is accepted when we send an order confirmation and successfully process your payment.

We may decline or cancel an order where permitted by law, including where a product is unavailable, an obvious pricing or description error has occurred, or the information provided is incomplete or inaccurate. If we cancel an order after payment has been taken, we will issue a refund for the amount paid for the cancelled order.

Please review your order carefully before submitting it, including the selected device model, keyboard model, layout and other options. Cancellation requests after an order has entered custom production may not be possible.

Your purchases are subject to our Return & Refund Policy. You represent that purchases are for personal or household use and not for unauthorized commercial resale.

SECTION 4 - PRICES AND BILLING

Prices, discounts and promotions may change without notice. The price charged for a product is the price shown at the time the order is placed and confirmed in your order confirmation.

Any taxes, shipping charges, customs duties or import charges that apply to your order will be shown at checkout or in your order confirmation where available.

You agree to provide current, complete and accurate payment and contact information and to promptly update it when necessary.

You represent that you are authorized to use the payment method provided and agree to pay all charges shown for your order, including any applicable taxes and charges presented at checkout.

SECTION 5 - SHIPPING, DELIVERY AND CUSTOMS

Products are normally prepared and packed within 2–3 business days before dispatch. Delivery estimates shown in our Shipping Policy are business-day estimates after dispatch and are not guaranteed delivery dates.

Standard shipping is free worldwide unless a different charge is shown at checkout.

Once an order ships, we will provide tracking information where tracking is available. Tracking updates may take time to appear after dispatch.

Delivery may be affected by carrier delays, customs processing, weather, incorrect or incomplete address information and other events outside our reasonable control.

If a package has not arrived after the estimated delivery window or tracking has stopped updating, please contact us with your order number so that we can review the tracking information and advise on the next steps.

Depending on the destination country, customs duties, import taxes or other charges may apply. The treatment of these charges depends on the information shown at checkout and in your order confirmation.

Unless your checkout or order confirmation expressly states that these charges are included, they may be payable by the customer.

Returns, replacements and refunds are handled under our Return & Refund Policy. Free outbound shipping does not automatically include free return shipping.

Please do not send any return without receiving written approval and return instructions from us.

SECTION 6 - INTELLECTUAL PROPERTY

Our Services, including trademarks, brands, text, displays, images, graphics, product reviews, video, audio and the design, selection and arrangement of these materials, are owned by BAREKEY, its affiliates or licensors and are protected by applicable intellectual property laws.

These Terms permit you to use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit material from the Services without our prior written consent.

All rights not expressly granted are reserved by BAREKEY, Shopify and their respective licensors.

You may be provided with access to tools offered by third parties. We do not monitor or control those tools and provide access to them as available and without endorsement.

Your use of optional third-party tools is at your own risk and subject to the terms provided by the relevant third party.

New features and tools added to the Services will also be subject to these Terms unless separate terms are provided.

The Services may contain links or materials provided by third parties. We are not responsible for examining or evaluating their content, accuracy, availability or practices.

If you access third-party websites or services, you do so at your own risk and should review their terms and policies.

Complaints about third-party products or services should be directed to the relevant third party.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

BAREKEY is powered by Shopify, which enables us to provide the Services. However, purchases made through this store are transactions between you and BAREKEY LTD.

Shopify is not responsible for the products, fulfilment, returns, refunds or other aspects of transactions between you and BAREKEY, except as required by applicable law or the terms that govern Shopify’s own services.

SECTION 10 - PRIVACY POLICY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because the Services are hosted by Shopify, Shopify may collect and process information about your access to and use of the Services.

Information may be transmitted to and shared with Shopify and service providers located in countries other than your country of residence in order to provide and improve the Services.

SECTION 11 - FEEDBACK

If you submit ideas, suggestions, feedback, reviews, proposals, plans or other content, you grant us a worldwide, royalty-free, sublicensable licence to use, reproduce, modify, publish, distribute and display that content for operating, improving and promoting the Services, subject to applicable law.

You represent that you own or have the necessary rights to the content you submit and that it does not infringe the rights of others or contain unlawful, abusive, misleading or malicious material.

We may remove content that violates these Terms or applicable law. You remain responsible for the content you submit.

There may occasionally be information in the Services that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times or availability.

We may correct such errors and update information where permitted by law.

If an obvious error materially affects an order and the order has not yet been fulfilled, we may contact you to confirm whether you wish to proceed or cancel the affected order for a refund.

You may use the Services only for lawful purposes.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, fraudulent misrepresentation or other liability that cannot legally be restricted.

SECTION 18 - INDEMNIFICATION

You agree to indemnify and hold harmless BAREKEY, Shopify and their respective affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from third-party claims, losses, damages and reasonable costs arising from your breach of these Terms, your violation of applicable law or third-party rights, or your misuse of the Services, except to the extent caused by our own unlawful acts or negligence.

If any provision of these Terms is determined to be unlawful, void or unenforceable, it will be enforced to the fullest extent permitted by law and the remaining provisions will remain in effect.

Our failure to exercise or enforce a right or provision of these Terms does not waive that right or provision.

These Terms and the policies referenced in them constitute the agreement between you and BAREKEY regarding the Services and supersede prior versions of these Terms, subject to any non-excludable rights under applicable law.

You may not transfer or assign your rights or obligations under these Terms without our written consent.

We may transfer or assign our rights and obligations where permitted by law, including in connection with a reorganization, sale or transfer of the business.

These Terms are governed by the laws of England and Wales.

Subject to any mandatory consumer protections in the country where you live, the courts of England and Wales will have jurisdiction over disputes arising from these Terms or your use of the Services.
